Dat klopt <strong>in grote lijnen<\/strong>, maar verdient belangrijke nuance.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14pt; color: #b22222;\"><strong>1. Belangrijkste nuance: vandaag nog niet verplicht in Belgi\u00eb<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">De verplichting vloeit voort uit <strong>Richtlijn (EU) <\/strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/NL\/ALL\/?uri=CELEX:32023L2673\"><strong>2023\/2673<\/strong><\/a>.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">Dit is een <strong>EU-richtlijn<\/strong>, geen rechtstreeks toepasselijke wetgeving.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">Ze moet eerst worden <strong>omgezet in Belgische wetgeving<\/strong><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Vandaag geldt dus:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">de Belgische omzetting is <strong>nog niet definitief afgerond<\/strong><\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">de verplichting is <strong>nog niet van kracht in Belgi\u00eb<\/strong><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Dit cre\u00ebert momenteel onzekerheid in de praktijk.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Tegelijk is de deadline op EU-niveau duidelijk:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">toepassing voorzien vanaf <strong>19 juni 2026<\/strong>, maar<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">dit zal in Belgi\u00eb pas effectief spelen na <strong>definitieve goedkeuring en inwerkingtreding van de omzettingswet<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;\">&#8211;&gt; <span style=\"text-align: justify;\">Bedrijven doen er dus goed aan zich al voor te bereiden, maar zijn vandaag nog niet verplicht om dit te implementeren.<\/span><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #b22222; font-size: 14pt;\"><strong>2. Wat zal er concreet verplicht worden?<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">De richtlijn voegt een nieuwe verplichting toe (in Belgi\u00eb voorzien via art. VI.61\/2 WER):<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">&#8211;&gt; Ondernemingen die overeenkomsten op afstand sluiten (zoals webshops) moeten een <strong>digitale herroepingsfunctie<\/strong> voorzien op hun website.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Concreet betekent dit dat de consument (<strong>voor overeenkomsten waarvoor een herroepingsrecht bestaat)<\/strong>:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">online en rechtstreeks via de website kan herroepen<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">via een functie die:<\/span>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">duidelijk zichtbaar is (\u201chier de overeenkomst herroepen\u201d of een ondubbelzinnige overeenkomstige formulering)<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">gemakkelijk toegankelijk is<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">beschikbaar blijft gedurende de herroepingstermijn<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">&#8211;&gt;\u00a0 Het uitgangspunt is duidelijk:<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif;\"><strong>herroepen moet even eenvoudig zijn als bestellen<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #b22222; font-size: 14pt;\"><strong>3. Verplichtingen rond de werking<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">De richtlijn gaat verder dan enkel \u201ceen knop\u201d en voorziet een <strong>gestandaardiseerd proces<\/strong>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Op basis van de richtlijn en het huidige wetsontwerp volgt:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Verwachte basisstructuur:<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #004b8c;\"><strong>1. Eerste stap (herroepingsfunctie)<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">consument geeft aan dat hij wil herroepen<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">met beperkte gegevens (naam, contract\/orderreferentie, contactgegevens)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #004b8c;\"><strong>2. Tweede stap (bevestiging)<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">aparte bevestigingsknop (\u201cherroeping bevestigen\u201d)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong><span style=\"color: #004b8c;\">3. <\/span><\/strong><strong><span style=\"color: #004b8c;\">Ontvangstbevestiging<\/span><\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">verplicht op een duurzame drager (bv. e-mail)<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">met datum en inhoud van de aanvraag<\/span><\/li>\n<\/ul>\n<p>&#8211;&gt; <span style=\"font-family: arial, helvetica, sans-serif;\">Dit betekent concreet:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">\u2705 Een <strong>tweestapsproces<\/strong> lijkt voorzien<\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif;\">\u2705 Een <strong>automatische bevestiging (bv. per mail)<\/strong> maakt deel uit van dit proces<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; color: #b22222; font-size: 14pt;\"><strong>4. Conclusie<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">\u2705 <strong>Ja, er komt een verplichting<\/strong> om herroeping digitaal via de website mogelijk te maken<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">\u2705 Dit zal in de praktijk neerkomen op een duidelijke \u201cherroepingsknop\u201d<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">\u2705 Het proces omvat:<\/span>\n<ul>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">een eerste herroepingsstap<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">een bevestigingsstap<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\">en een automatische ontvangstbevestiging<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Maar: vandaag is dit nog niet verplicht in Belgi\u00eb<\/strong>, aangezien de wet nog niet definitief is aangenomen<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #004b8c;\"><strong>Aanbeveling voor je onderneming:<\/strong><\/span><br \/>\n<span style=\"font-family: arial, helvetica, sans-serif;\">Begin tijdig met voorbereidingen, maar wacht de <strong>definitieve Belgische omzetting<\/strong> af voor de exacte implementatievereisten.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>F A C T\u00a0 \u00a0C H E C K Komt er een verplichte herroepingsknop voor webshops? &nbsp; \u2611 JA De laatste weken circuleert informatie dat webshops verplicht worden om een \u201cherroepingsknop\u201d te voorzien vanaf 19 juni 2026.
